TERMS & CONDITIONS – “RETROMOTIVE STORIES SURVEY GIVEAWAY”
1. Organizer and general information
The organizer of the “Retromotive Stories Survey Giveaway” (the Promotion) is Retromotive Pty Ltd, 12 Love St, Bulimba QLD 4171, Australia, ABN: 11 657 787 990 (Organizer).
The Promotion is run via the Organizer’s Instagram account @retromotive (Profile).
The Promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram. Instagram is not responsible for the Promotion in any way.
By taking part in the Promotion, participants accept these Terms & Conditions (Terms).
2. Promotion period
The Promotion starts on 27 November 2025, 9:00 am GMT+10 and ends on 28 November 2025, 9:00 am GMT+10
The survey and creative question will be available via Instagram Stories on the Profile during the Promotion Period.
The Organizer will select and announce the winner no later than 5 December 2025 via a Story or post on the Profile and by direct message (DM) to the winner.
3. Eligibility
The Promotion is open to individuals who:
are at least 18 years old at the time of entry;
have a valid, public or private Instagram account; and
live in a country to which the Organizer can reasonably ship the prize and where participation in such promotions is not prohibited by local law.
Employees, contractors and regular collaborators of the Organizer, as well as members of their immediate families, are not eligible to enter.
Participation in the Promotion is free of charge and voluntary.
4. How to enter
During the Promotion Period, participants may enter the Promotion by completing the following steps:
View the survey in Instagram Stories on the @retromotive Profile.
Answer the survey questions shown in Stories (multiple-choice / poll questions).
Complete the creative task by answering the final open question in the Story, The answer may be submitted directly in the answer box in the Story or, if indicated in the Story, by sending a DM to @retromotive with the answer.
Only entries that include a completed creative answer as described above will be considered valid entries in the Promotion (Entry/Entries).
Each person may submit one Entry. If multiple Entries are submitted by the same person, the Organizer may count only the first complete Entry.
Entries must:
be the participant’s own original work;
not include offensive, illegal, hateful, discriminatory or otherwise inappropriate content;
not infringe the rights of any third party (including copyright, trademarks, privacy or image rights).
Entries submitted after the Promotion Period or that do not follow these Terms may be disqualified at the Organizer’s discretion.
5. Prize
There is one (1) prize available in the Promotion (Prize):
1 × latest issue of Retromotive magazine, and
1 × Retromotive T-shirt (size subject to availability; the Organizer will do its best to match the winner’s requested size).
The approximate retail value of the Prize is 80 USD.
The Prize is non-transferable and cannot be exchanged for cash or other products.
The Organizer will cover standard shipping costs of the Prize to the winner’s address. Any customs duties, import taxes or local charges (if applicable) are the responsibility of the winner.
6. Winner selection – game of skill
This Promotion is a game of skill, not a game of chance. The winner is selected based on the quality of their creative answer, not by random draw.
After the Promotion Period ends, all valid Entries will be reviewed by a panel of at least two representatives of the Organizer (Jury).
The Jury will select one (1) winner based on the following criteria:
creativity and originality;
clarity and expressiveness;
alignment with the spirit of Retromotive and the theme of characterful / classic cars.
The Jury may also select one or more backup winners (reserve list) in case the initially selected winner cannot be contacted or is disqualified.
The Jury’s decision is final and not subject to appeal.
7. Winner notification and prize fulfilment
The Organizer will contact the selected winner via Instagram direct message (DM) from the @retromotive account within [e.g. 3 days] after the winner is chosen.
The winner must respond to the DM within [e.g. 3 days] of the message being sent, confirming:
that they accept the Prize; and
their full name, postal address, phone number (if required for delivery) and preferred T-shirt size.
If the winner:
does not respond within the specified time;
cannot be contacted; or
does not provide the required details,
the Organizer reserves the right to disqualify that winner and award the Prize to a backup winner selected by the Jury.The Organizer will dispatch the Prize within [e.g. 30 days] after receiving the correct shipping details from the winner.
The Organizer is not responsible for incorrect or incomplete contact details provided by the winner, or for any delays or issues caused by postal or courier services.
8. Use of Entries and intellectual property
By entering the Promotion, the participant confirms that their Entry is original and does not infringe any rights of third parties.
By accepting the Prize, the winner grants the Organizer a non-exclusive, worldwide, royalty-free licence to use their winning Entry (creative answer) for promotional purposes related to Retromotive, including:
posting or re-posting the Entry on the Organizer’s social media channels;
including the Entry, in whole or in part, in digital or print content (e.g. posts, newsletters, articles).
Where reasonably possible, the Organizer will credit the winner by mentioning their Instagram handle (username) when using the Entry.
9. Personal data and privacy
The Organizer will process participants’ personal data in accordance with applicable privacy laws.
For the purposes of the Promotion, the Organizer may process the following personal data:
Instagram username;
for the winner – full name, postal address, phone number (if required for delivery), T-shirt size and any correspondence regarding the Prize.
Personal data is processed for the following purposes:
organizing and administering the Promotion;
selecting the winner;
contacting the winner and delivering the Prize;
complying with legal and record-keeping obligations.
Providing personal data is voluntary, but failure to provide the data necessary for Prize fulfilment will mean the Prize cannot be delivered.
Personal data will be retained for as long as reasonably necessary to administer the Promotion, deliver the Prize and comply with legal obligations, and then securely deleted or anonymised.
Participants may contact the Organizer at wheels@retromotive.co to request access to, correction or deletion of their personal data, or to ask questions about data handling.
10. Complaints and queries
Any questions or complaints regarding the Promotion should be sent by Instagram DM to @retromotive or by email to wheels@retromotive.co with the subject line “Retromotive Stories Survey Giveaway”.
The Organizer will make reasonable efforts to respond to questions and complaints within 14 days.
11. Changes and final provisions
The Organizer reserves the right to amend these Terms or to cancel the Promotion at any time if circumstances beyond its reasonable control make it necessary, provided that such changes do not unfairly disadvantage participants who have already entered. Any material changes will be announced on the Profile.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
These Terms are governed by the laws of Queensland, Australia, and any disputes arising in connection with the Promotion shall be subject to the non-exclusive jurisdiction of the courts of Queensland, Australia.
